How We Bill & Your Responsibilities

Payment Responsibilities

The customer agrees to pay all charges associated with the service, including, but not limited to, installation charges, monthly service charges, equipment charges, and any applicable local, state, or federal taxes.

How We Bill

Unless you are subject to a minimum term agreement, Siuslaw Broadband LLC dba Hyak’s services are rendered on a month-to-month basis. You will be billed monthly for recurring service and/or equipment charges, and any other fees. Your first bill will show charges for your first month of service and any fees and is billed and due on your installation or anniversary date.

Invoices are generated 14 days before your bill due date on the next cycle after your installation. Automatic payments will be debited on the due date for the full amount of the invoice to the method on the subscribers account.

Subscriber accounts are configured to have payments automatically charged to their credit or debit card. To opt out of auto-pay subscribers must call the office to make the change at 541-902-5101. Auto-pay subscribers will have their accounts debited on the due date of the invoice.

Alternative Billing Arrangements

On occasion, Hyak, at its sole discretion, may elect an alternative method of collecting payments. Any such alternative billing method will be detailed on a subscriber-to-subscriber basis.

Late Fees and Interest

You will be billed a late fee of $10 if the full payment amount of the balance due on the invoice is not received by the due date.

Account/Services Suspension

If no payment is made to the account within 14 days after the due date, all services may be suspended. Fees and other charges may apply to have the service reinstated. You give Hyak the right to attempt any collections efforts to recoup outstanding balances.

Termination for Non-Payment

If no payment is made to the account within 30 days after the due date, all services will be terminated. Any equipment is considered the property of Hyak and must be returned. Failure to comply will result in additional fees.

Early Termination

We offer a free installation for new subscribers, which normally costs $399.99. However, if you terminate the service within the first 12 months of service, this installation fee will be applied. The fee will be reduced by $100 for each quarter of service completed. This fee is to cover the equipment and time to install.

Non Returned Equipment

Failure to return Hyak-owned equipment after the termination of your service will result in a fee being charged to your account. The fee for non-returned ONT is $150 per unit. The fee for a non-returned router/gateway is $190. This fee will automatically be charged to your account and become due.

Collection Expense

On occasion, Hyak may elect to use a collection agency or attorney to collect money owed. The fees may include attorney’s fees, collection agency fees, and court costs, and you agree to pay the reasonable costs of collection.

Credit Inquiries

You authorize Hyak, at its sole discretion, to make inquiries and receive information about your credit experience from others, to submit information to credit bureaus, and to disclose this information to appropriate third parties for reasonable business purposes.

Refund Policy

Hyak bills in advance of the month of use for the service. Unless you are subject to a minimum term agreement, you may cancel your account at any time. Your service will terminate the month of your request and no further monthly invoices will be sent. We do not pro-rate the final month of service.

Force Majeure

Notwithstanding the above, either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to:

  • A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or
  • War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not); or
  • Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.

Indemnification

The customer will defend, indemnify, and hold Hyak harmless from any and all claims, losses, liabilities, damages, expenses, and costs (including attorneys’ fees and court costs) arising from or relating to any claims regarding elements or materials provided by the customer.

No Responsibility for Loss or Damages

Hyak will have no responsibility for any third-party disrupting, intruding, or otherwise copying files in part or whole on all or any part of the network. Hyak is not responsible for damages incurred by a loss of product or service except as set forth in the corresponding product's.
